These Terms of Service (“Terms”) govern your access to and use of the website located at https://turningthetidetutoring.com/ (the “Site”) and any tutoring, educational support, communications, and related offerings provided by Turning The Tide Tutoring (“Company,” “we,” “us,” or “our”) (collectively, the “Services”).
By accessing the Site, submitting a form, booking a session, scheduling with us, enrolling in a service, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

2. Eligibility; Minors
The Services are intended for individuals who are at least 18 years old, and for minors only with the knowledge, consent, and involvement of a parent or legal guardian.
If you are a parent or legal guardian using the Services for a minor, you represent and warrant that:
you have authority to do so;
you accept these Terms on the minor’s behalf; and
you are responsible for all communications, permissions, and compliance related to that minor’s use of the Services.
3. Services Provided
Turning The Tide Tutoring provides tutoring and educational support services. Our Site describes tutoring support across a wide and diverse range of subjects, and our offerings may expand based on tutor availability and interest.
Services may include, as made available by us from time to time:
tutoring and academic support;
individualized learning support;
booking and scheduling of sessions;
educational communications related to the Services; and
other related support expressly offered by us.
We may modify, update, suspend, or discontinue any part of the Services at any time. If a material change affects active clients, we will use reasonable efforts to provide notice.
4. Scheduling, Attendance, and Conduct
4.1 Scheduling
Sessions may be scheduled through the Site, our booking tools, or other Company-provided communication methods. You are responsible for providing accurate contact information and keeping your availability current.
4.2 Attendance and Punctuality
Sessions begin and end at the scheduled time unless we agree otherwise in writing. Late arrival does not extend the scheduled session unless we expressly approve it.
4.3 Conduct
You agree to behave respectfully and in a manner that does not disrupt instruction, interfere with service delivery, or create safety concerns. We may pause or end a session if conduct materially interferes with the Services.
5. Fees, Billing, and Payment
Any fees, billing terms, payment timing, credits, refund rules, and payment processor information applicable to a particular service will be disclosed at the time of booking, in the relevant service description, or in a separate written agreement, if applicable.
Unless otherwise stated in writing:
amounts are due as communicated at booking or invoicing;
we may require a valid payment method on file;
late or failed payments may result in suspension of Services; and
any dispute over charges should be raised promptly with us before initiating a chargeback or similar reversal.
6. Cancellations and Rescheduling
Any cancellation, rescheduling, or attendance terms applicable to a particular session or service will be disclosed at the time of booking or in a separate written agreement, if applicable.
We may reschedule or cancel a session due to illness, emergency, tutor unavailability, technical issues, or other reasonable circumstances. In such cases, we will use reasonable efforts to offer a make-up session or other appropriate resolution.
7. Educational Disclosures; No Guarantees
Educational results depend on many factors outside our control, including student effort, attendance, prior skill level, learning differences, consistency, and third-party requirements.
Accordingly:
we do not guarantee specific grades, test scores, admissions outcomes, scholarship outcomes, or timelines;
testimonials, examples, and success stories are illustrative only; and
any statements about improvement reflect general educational goals, not promises of a particular result.
8. Technology and Remote Services Disclaimer
To the extent any Services are delivered remotely or rely on third-party technology, the Services may depend on internet connectivity, software, hardware, and third-party systems outside our control.
We are not responsible for delays, interruptions, or failures caused by technology issues not reasonably within our control. We will use reasonable efforts to resolve or reschedule materially affected sessions when appropriate.
9. Acceptable Use of the Site
You agree not to:
use the Site or Services for any unlawful purpose;
interfere with the operation, security, or integrity of the Site or Services;
copy, scrape, reproduce, distribute, or exploit Site content except for personal, non-commercial use where permitted by law;
introduce malware or attempt unauthorized access; or
misuse the Site, Services, or our communications systems in any way.
We may suspend or terminate access for any violation of these Terms.
10. Intellectual Property
All Site content and Service-related materials, including text, graphics, logos, lesson materials, worksheets, templates, communications, and other proprietary content, are owned by Turning The Tide Tutoring or its licensors and are protected by intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable license to use such materials only for your own educational purposes in connection with the Services. You may not reproduce, distribute, sell, sublicense, or create derivative works from our materials without our prior written consent.
11. Recordings and Materials
We may create or use notes, lesson materials, and other session-related content in connection with the Services. Any recordings or materials provided by us remain our property unless we agree otherwise in writing or applicable law requires a different result.
If any recording or similar collection is used, we will handle it in accordance with applicable law and any separate notice or consent requirements.
12. Privacy
Our collection and use of personal information is governed by our Privacy Policy, if posted on the Site, which is incorporated into these Terms by reference.
13. Text Message Communications (SMS)
By providing your phone number through the Site, a booking flow, a form, or another opt-in method, you consent to receive text messages from Turning The Tide Tutoring.
SMS messages may include:
appointment confirmations;
scheduling reminders;
booking or session updates;
tutor or service-related communications;
administrative notices; and
other support-related messages tied to your use of the Services.

Consent to receive text messages is not a condition of purchase.
18+ SMS Consent Restriction: You must be at least 18 years old to consent to receive SMS messages from us. If you are under 18, a parent or legal guardian must provide consent and manage communications on your behalf.
Carrier Disclaimer: Wireless carriers are not liable for delayed, undelivered, or misdirected messages. Message delivery depends on your mobile provider, device settings, and network availability.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

15. Limitation of Liability
To the fullest extent permitted by law:
we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages;
we are not liable for lost profits, lost opportunities, loss of data, or business interruption; and

16. Indemnification
You agree to indemnify, defend, and hold harmless Turning The Tide Tutoring, its owners, tutors, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your use of the Site or Services;
your violation of these Terms;
your violation of any law or third-party right; or
any content or information you submit to us.
17. Termination
We may suspend or terminate your access to the Site or Services at any time if you materially breach these Terms, fail to pay amounts owed, misuse the Services, or engage in conduct that interferes with our operations or the experience of other users.
Termination does not relieve you of obligations incurred before termination.
18. Governing Law; Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Before filing a formal legal claim, both parties agree to make a good-faith effort to resolve the dispute informally. If the dispute is not resolved, the matter shall be brought in a court of competent jurisdiction located in Virginia, unless applicable law requires otherwise.
19. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date reflects the most recent version. Your continued use of the Site or Services after any changes become effective means you accept the updated Terms.
20. Miscellaneous
Entire Agreement. These Terms and any posted Privacy Policy, booking terms, or service-specific agreement constitute the entire agreement between you and us regarding the Site and Services.
Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
No Waiver. Our failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations as permitted by law.
